The Fachkräfteeinwanderungsgesetz is the framework law for all skilled settlement in Germany, amended and expanded from 2023 to 2024. The Fachkräfteeinwanderungsgesetz sets out the pathways, conditions and improvements for workers from outside the EU. This article explains this law.

Fachkräfteeinwanderungsgesetz là gì

The Fachkräfteeinwanderungsgesetz (Skilled Immigration Act, abbreviated FEG) is Germany’s framework law for skilled labour immigration from outside the EU and EEA. The law was first enacted in 2020 and significantly amended from 2023 to 2024 to substantially expand the pathways.

The FEG sets out the conditions for the EU Blue Card, work permits for skilled workers, the Chancenkarte, and related categories. The law also governs the mechanism for recognizing foreign qualifications, forming the basis for many skilled-migration pathways to Germany.

Three implementation phases of the 2023–2024 amendment

The FEG amendment was rolled out in three phases. Phase 1, from November 2023, improved the EU Blue Card and broadened the definition of skilled labor. Phase 2, from March 2024, applied to recognized occupations and work permits.

Phase 3, from June 1, 2024, introduced the Chancenkarte and doubled the Western Balkans quota from 25,000 to 50,000 approvals per year. Each phase opened up further pathways for different groups of candidates under the Fachkräfteeinwanderungsgesetz.

The most important changes

Under the amended Fachkräfteeinwanderungsgesetz, the EU Blue Card salary threshold was significantly lowered, the shortage-occupation list was expanded, IT specialists without a university degree are recognized if they have 3 years of experience within the past 7 years, and the Chancenkarte was introduced for jobseekers.

The specific EU Blue Card salary threshold is updated annually based on the pension insurance contribution ceiling. Interested parties should check the current version of the Fachkräfteeinwanderungsgesetz and related regulations from official government sources.

You should refer to German Skilled Immigration Act and EU Blue Card Duc to check current conditions.
